1. Broker Status, Carrier Assignment, and Shipper Acknowledgment

Trustline Carriers LLC is a federally licensed property broker (MC# 1661496) registered with the Federal Motor Carrier Safety Administration (FMCSA). As a broker, Trustline Carriers LLC does not take possession, custody, or control of any vehicle, does not employ drivers, does not own or lease transport equipment, and exercises no operational control over any carrier. The assigned carrier is an independent contractor solely responsible for the vehicle during transport. Trustline Carriers LLC endeavors to ensure that the carrier provides timely transportation but does not guarantee specific pickup or delivery dates. We are not liable for delays caused by carrier schedules, weather, or mechanical failures. Trustline Carriers LLC uses commercially reasonable efforts to select carriers that are licensed, insured, and in good standing with the FMCSA at the time of assignment, but makes no representation or warranty regarding any carrier’s ongoing compliance, safety record, or performance. Shipper may independently verify carrier credentials at www.fmcsa.dot.gov.

Shipper expressly acknowledges and agrees that: (a) Trustline Carriers LLC is a broker, not a motor carrier; (b) the assigned carrier is solely responsible for the vehicle during transport; (c) Trustline Carriers LLC does not guarantee carrier performance; (d) Shipper’s recourse for any vehicle damage, loss, delay, or carrier-related claim is exclusively against the assigned carrier and/or its insurer; and (e) Shipper has been advised to obtain independent insurance coverage if desired beyond that provided by the assigned carrier.

2. Insurance, Claims, and Condition Report

The assigned carrier provides cargo insurance ranging from $100,000 to $250,000 per load, with a minimum of $750,000 in public liability and property damage coverage. All claims for vehicle damage, loss, or theft must be made directly against the assigned carrier and its insurer. Trustline Carriers LLC is not a proper party to any such claim. Upon request, Trustline Carriers LLC will provide the assigned carrier’s name, USDOT number, MC number, and insurance information to facilitate claims. Trustline Carriers LLC’s sole obligation with respect to claims is limited to providing this identifying information.

A vehicle condition report (Bill of Lading) will be completed by the carrier at pickup and delivery. Shipper or Shipper’s designated representative must be present at both pickup and delivery to inspect the vehicle, note any damage, and sign the condition report. Any damage not noted at delivery before the driver departs shall constitute a waiver of any damage claim and conclusive evidence that the vehicle was delivered in the same condition as received. Shipper is encouraged to photograph the vehicle at both pickup and delivery. All claims must be submitted in writing within 15 days of delivery.

3. Personal Property and Luggage

Only personal belongings confined to the vehicle’s trunk, weighing no more than 200 lbs and excluding heavy or hazardous items, are permitted. The carrier is not liable for damage caused by excessive or improper loading. For shipments to Hawaii and Alaska, vehicles must be emptied except for factory-installed equipment. Unremoved items are transported at the Shipper’s sole risk and expense.

4. Vehicle Condition Requirements

Vehicles must be operable and contain no more than half a tank of fuel. Vehicles leaking fluids, with mechanical issues, or with unsecured components are subject to additional fees or refusal of transport. A $150 fee applies to non-operational vehicles or those that become non-operational during transit and will be added to the original quote, payable at delivery in accordance with Section 5.

5. Payment Terms

Reservation fees must be paid via credit card and include a 4% processing fee. Payment methods for the balance due include cash, certified funds, cashier’s check, or money order only. Personal or business checks and credit card payments are not accepted for Cash on Delivery (COD) shipments. Pickup and delivery occur at the door unless restricted by local regulations. Appointment pickup is available for an additional fee. Reservation fees must be paid only to authorized Trustline Carriers LLC accounts. Payments to external or unauthorized accounts will not be recognized. Shipper should verify payment information with Trustline Carriers LLC prior to payment.

6. Rescheduling and Cancellation Fees

If the vehicle is not ready at pickup, a $100 rescheduling fee applies. Shipper must notify Trustline Carriers LLC promptly if it or its representative cannot be present. Orders canceled within seven (7) calendar days before or after the scheduled pickup incur a minimum administrative fee of $200. Trustline Carriers LLC reserves the right to cancel orders without refund if the vehicle becomes unavailable.

7. Payment Obligations and Chargeback Waiver

Shipper agrees that all payments made to Trustline Carriers LLC represent broker arrangement fees only. Shipper expressly waives any right to initiate credit card chargebacks, payment disputes, or reversals for claims arising from carrier performance, vehicle damage, loss, theft, delay, or any other carrier act or omission. Shipper acknowledges that the appropriate remedy for any such claim lies exclusively against the assigned carrier and/or its insurer. Any chargeback initiated in violation of this provision shall entitle Trustline Carriers LLC to recover all amounts reversed, plus reasonable attorney’s fees and costs incurred in disputing the chargeback. Shipper agrees to pay the quoted price in full and will not initiate chargebacks on credit card payments.

8. Limitation of Liability and Warranty Disclaimer

To the maximum extent permitted by applicable law, Trustline Carriers LLC’s total liability to Shipper for any cause whatsoever, and regardless of the form of the action, shall not exceed the broker fee paid by Shipper to Trustline Carriers LLC for the specific shipment giving rise to the claim. Trustline Carriers LLC is not liable for vehicle damage, loss, theft, diminution in value, consequential damages, loss of use, or any other damages arising from carrier performance or non-performance, and makes no warranties beyond the carrier’s insurance coverage.

9. Indemnification

In the event Trustline Carriers LLC is made a party to any legal action, arbitration, or regulatory proceeding arising from a carrier’s acts or omissions, Shipper agrees to indemnify, defend, and hold harmless Trustline Carriers LLC, its agents, and carriers from all claims, damages, judgments, and costs, including reasonable attorney’s fees. This indemnification obligation survives termination of these Terms and Conditions.

10. Pre-Claim Notice Requirement — Surety Bond

As a condition precedent to filing any claim against Trustline Carriers LLC’s surety bond, Shipper must provide Trustline Carriers LLC with written notice of the nature and basis of the claim no less than forty-five (45) days prior to submitting any claim to Trustline Carriers LLC’s surety or bonding company, transmitted in accordance with Section 13. Such written notice must include: (a) a detailed description of the claim, including the date of pickup, date of delivery, and vehicle identification information; (b) the specific acts or omissions alleged to give rise to the claim; (c) a description of the alleged loss or damage, including supporting documentation such as photographs, repair estimates, or appraisals; and (d) the dollar amount of the claim being asserted. During the 45-day notice period, Trustline Carriers LLC shall have the opportunity to investigate, respond to, and attempt to resolve the claim. Shipper’s failure to provide timely written notice as required herein shall constitute a waiver of any right to make a claim against Trustline Carriers LLC’s surety bond arising from the subject shipment.

11. Venue, Governing Law, and Jurisdiction

These Terms and Conditions are governed by the laws of the State of Florida without regard to its conflict of laws principles. Any dispute not resolved by mediation or arbitration shall be brought exclusively in the state courts of Orange County, Florida, or the U.S. District Court for the Middle District of Florida, Orlando Division, sitting in Orlando, Florida, as appropriate based on subject matter jurisdiction. Each party irrevocably submits to personal jurisdiction in those courts and waives any objection to venue or inconvenient forum. Shipper acknowledges that this venue selection is reasonable given that Trustline Carriers LLC maintains its principal place of business in Orlando, Florida.

12. Force Majeure

Trustline Carriers LLC is not liable for delays or failures caused by events beyond our control, including but not limited to natural disasters, acts of God, war, terrorism, government restrictions, strikes, carrier scheduling, or severe weather.

13. Notices

All notices required or permitted under these Terms and Conditions must be in writing and are effective upon: (a) personal delivery; (b) three (3) business days after deposit as USPS certified mail, return receipt requested; (c) one (1) business day after deposit with a nationally recognized overnight courier with tracking; or (d) email upon written confirmation of receipt by the intended recipient (auto-generated delivery or read receipts do not qualify).

Trustline Carriers LLC is not responsible for failed notice due to Shipper’s failure to update contact information. Trustline Carriers LLC reserves the right to update its notice address upon written notification to Shipper.

14. Insurance Advisory and Privacy

Shipper is advised to review their personal auto insurance policy or obtain separate transit insurance prior to shipment, as carrier-provided cargo insurance may contain exclusions, deductibles, or coverage gaps. Trustline Carriers LLC makes no representation that carrier insurance will fully cover any particular loss. Trustline Carriers LLC collects and uses customer information solely to provide transportation services and protects such data in accordance with applicable privacy laws. For details, see our Privacy Policy at www.trustlinecarriers.com.

15. Electronic Signature Acknowledgment

Shipper agrees that an electronic signature affixed to these Terms and Conditions, whether through a digital signature platform, email confirmation, click-through acceptance, or any other electronic means, shall be legally binding and enforceable to the same extent as an original handwritten signature. Shipper expressly consents to the use of electronic signatures and agrees that these Terms and Conditions shall not be denied legal effect, validity, or enforceability solely because an electronic signature was used. Electronic signatures are governed by and valid under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq., and applicable state law, including the Uniform Electronic Transactions Act (UETA) as adopted in the applicable jurisdiction. Shipper acknowledges that the electronic signature captured in connection with these Terms and Conditions, including the signer’s name, email address, IP address, and timestamp, constitutes sufficient evidence of Shipper’s identity and intent to be bound by all terms herein. Shipper waives any defense to enforcement of these Terms and Conditions based solely on the electronic nature of the signature.

16. Incorporation into Order Documents

These Terms and Conditions are incorporated by reference into and form an integral part of every Order Invoice, booking confirmation, rate quote, and any other order or transaction document issued by Trustline Carriers LLC. In the event of any conflict between these Terms and Conditions and any Order Invoice or other transaction document, these Terms and Conditions shall control unless a specific provision of the Order Invoice expressly supersedes a specific provision herein by written reference. Shipper’s execution of any Order Invoice, whether by handwritten or electronic signature, constitutes Shipper’s acknowledgment that Shipper has read, understood, and agrees to be bound by these Terms and Conditions in their entirety, regardless of whether a separate copy is physically attached to any individual Order Invoice.

17. Acceptance of Terms

By signing below, Shipper agrees to all terms and conditions set forth herein.

Order Invoice provisions

A signed agreement includes only the provisions for the options or discount on that order. An order with none has no such section.

These provisions are part of the Order Invoice for this order and apply only to the options and discount listed on its first page. Under Section 16, each provision supersedes only the specific term it names. Every other term applies as written.

Guaranteed pickup date ($200). The carrier picks up the vehicle on the guaranteed pickup date stated in this agreement, which Shipper chose when booking. For the pickup date only, this provision expressly supersedes the statement in Section 1 that Trustline Carriers LLC does not guarantee specific pickup or delivery dates. The $200 is part of the Reservation. If the carrier does not pick up the vehicle on that date, Trustline Carriers LLC refunds the $200 to Shipper’s card. The guarantee does not cover the delivery date, and it does not apply if the vehicle, or the person handing it over, is not ready at the pickup address on that date.

Expedited dispatch ($350). Trustline Carriers LLC offers the vehicle to carriers with priority and at a higher carrier rate, so that a carrier is likely to accept it sooner. The $350 is added to the COD to Carrier and paid at delivery. Expedited dispatch does not guarantee a pickup or delivery date, and Section 1 applies to all dates.

Military discount ($100). The discount is taken off the Reservation; any part the Reservation cannot absorb comes off the COD to Carrier. It is conditional on a Trustline Carriers LLC coordinator confirming, before dispatch, that Shipper is an active-duty service member, a veteran or a military spouse, from a military ID, a DD-214 or current orders. If eligibility is not confirmed before dispatch, the $100 is added back to the Reservation, and Trustline Carriers LLC notifies Shipper by email before that amount is charged.
